A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.

The situation originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was held in federal detention.

In her decision, the judge pointed out that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
